Through the websitewww.konfian.com(hereinafter the “Site”), BALESS offers the following services: (i) Directory, (ii) Online Appointment Booking and (iii) Cashback Services. These services are offered solely to natural or legal persons who have validly registered on the Site (hereinafter the “ Clients ”).
The purpose of these General Terms of Service (CGS) is to define the terms and conditions under which BALESS (hereinafter “ BALESS ”) makes the Services available to Clients.
These CGS apply to any service contract concluded between BALESS and any Client, hereinafter referred to together as the “ Parties ” or individually as a “ Party ”.
In order to benefit from the Services offered by BALESS, the Client must read these CGS and accept them without reservation.
The Client is also invited to read the General Terms of Use (CGU) of the Site. For the subscription terms applicable to professionals, users are invited to consult the General Terms of Subscription (CGA) accessible on the Site.
Through the Site, BALESS offers an online Directory Service listing numerous service professionals (hereinafter the “ Professionals ”), listed on the Site and offering their services in metropolitan France.
The Directory Service is freely accessible to any user, whether or not they hold a user account.
Through the Site, BALESS offers Clients an online Appointment Booking Service with the Professionals.
From the Professional’s profile page, the Client selects the service they wish to book and the date of the service from the booking calendar. The Client must select an available date; failing this, the service cannot be booked. If the Professional offers the option of home services, the Client must indicate their address.
The Client must read and accept any terms of service of the Professional.
The Client may book only one session at a time with the same Professional. The Client may book another session with that Professional only once the first session has taken place (this applies if the client has paid for several sessions at the time of booking).
If the Professional accepts instant booking, the Client must confirm their Booking and pay the amount payable online for the service upon confirmation.
If the Booking is subject to acceptance by the Professional, the Client must confirm their Booking and await the Professional’s response. If the Professional confirms the Booking, the Client must then pay the amount payable online for the service as soon as the notification is received.
If payment is not made within the stated time limits, the Client’s Booking is automatically cancelled.
The Client may cancel their Booking online, from their personal area, up to the cancellation deadline set by the Professional (for example two (2), twenty-four (24), forty-eight (48) or seventy-two (72) hours before the start of the service). This deadline is indicated to the Client before payment and restated in the confirmation e-mail. Outside this deadline, no cancellation is possible via the Site. The Professional may also cancel a Booking.
In the event of cancellation by the Client within the deadline, the Client is refunded the sums paid by bank card, less processing fees of at most 2 % of the amount paid plus €0.25 for a card issued in Europe, and a higher amount for a card issued outside Europe. These fees correspond to the fees of the payment service provider which the latter does not return upon a refund; they are calculated pro rata to the portion refunded. The exact amount of the refund is indicated to the Client before they confirm the cancellation. In the event of cancellation by the Professional, the Client is refunded in full, free of charge. The refund is made to the means of payment used for the Booking. Whichever party initiates the cancellation, the portion of the Booking paid with Cashback is returned to the Client in the form of Cashback. A cancelled Booking does not give entitlement to Cashback.
For any request to modify or postpone the service, the Client must contact the Professional directly. Likewise, if the Client wishes to exercise their right of withdrawal under the conditions provided for by law, they must inform the Professional directly.
BALESS acts solely as an intermediary and is not a party to the service contract concluded between the Client and the Professional. BALESS does not intervene in any way in the settlement of disputes between Clients and Professionals.
The prices stated on the Site are expressed in euros inclusive of all taxes at the applicable VAT rate. In the event of a change in the applicable VAT rate, the amended rate shall apply automatically.
The prices displayed for services are freely set by the Professionals. The price applicable to a Client’s order is calculated on the basis of the rates in force at the time the Client places the order.
Prices do not include the costs of supplying equipment or software or the telecommunication costs necessary to access and use the Services.
Confirmation of the order by the Client entails an obligation to pay, in accordance with the terms indicated on the service page and restated to the Client before they confirm their Booking. Online payment is made by bank card and, for a service offered by a Professional established in Belgium, also by Bancontact, through the payment service provider STRIPE. Depending on what the Professional has chosen for the service concerned, the Client pays online either the full amount of the order or a deposit, the balance then being paid directly to the Professional on site; certain services are paid entirely on site, without any online payment. Where the Professional offers this option, the Client chooses for themselves between online payment and payment on site. Where the Booking is subject to the Professional’s approval, the Client pays for their Booking after the Professional has accepted their request and, where applicable, within the time limit then indicated to them. Where a service is offered on quotation, its price is communicated by the Professional after examining the request, before any payment. Where the Professional travels, any travel costs are indicated to the Client before the Booking is confirmed and, depending on the Professional’s choice, paid online or on site. The Client may also use their Cashback to pay for all or part of the Booking: where the Client has a balance, it is offered to them by default at the time of payment, up to the amount payable online, and the Client may reduce the amount used or choose not to use it.
In the event of payment by bank card, the Client must pay the price due for the service at the time the Booking is confirmed. The Client certifies that they are the holder of the bank card used and that they hold the necessary authorisations. By providing the information relating to their bank card, the Client authorises their bank card to be debited for the amount payable online.
Payments on the Site are made through the payment service provider, the company STRIPE, which is responsible for the storage and automated processing of bank details in a secure environment.
Through the Site, BALESS offers a Cashback Service, which enables the Client to obtain, subject to the conditions detailed below, a certain sum of money that may be used to pay for services booked through the Site.
Cashback is paid to the Client by BALESS into a balance accessible from the user account and its amount represents a percentage of the sum paid by the Client when booking a service.
The amount of Cashback for each transaction is calculated solely on the basis of the sums paid by bank card, no Cashback being granted on sums paid with Cashback.
Obtaining Cashback is strictly subject to the following cumulative conditions:
(a) Cashback is granted only once the booked service has been performed; no Cashback is granted if the service is cancelled.
(b) Cashback is granted only on condition that the Client leaves a review on the Professional’s profile page, under the conditions provided for in Article 4 below.
Cashback must be used before 31 December of the current year: each Cashback is valid from its issue until midnight on 31 December of the year of its issue. On 1 January, the unused Cashback balance is reset to zero; a Client who has a balance is informed of this by e-mail during the month of December. The Cashback amount may be used only on the Site and to pay all or part of the amount of services booked with the Professionals listed on the Site.
The face value of a Cashback is fixed and expressed in euros (EUR). It cannot be converted into cash or scriptural money. If the Cashback has not been used before the expiry date, no refund may be made.
If the order amount exceeds the Cashback balance, the Client must complete their payment using one of the means of payment accepted on the Site. The Cashback amount may be used in several instalments and divided until a balance of 0.00 EUR (ZERO EURO) is reached.
Cashback may be awarded only once for the same order.
Where the Client withdraws from a service paid for in whole or in part with Cashback, the portion paid with Cashback is returned to them in the form of Cashback.
BALESS allows Clients who have received a service to leave a review of the service performed. The publication of a review is a condition for obtaining Cashback, as provided for in Article 3.3 above.
After the service (in principle twenty-four (24) hours after it ends), the Client receives an e-mail from BALESS containing an Internet link to leave a review of the service. From the date on which that e-mail is sent, the Client has a period of fourteen (14) days to publish a review on the Site and obtain the Cashback, whatever the rating given. After that period, the review may still be published, but the right to Cashback is lost.
The Client is solely responsible for the content they publish on the Site. The Client may not use this channel to exercise their right of withdrawal or to invoke a legal guarantee. The publication of a review has no effect on the Client’s ability to exercise their right of withdrawal or to invoke a legal guarantee.
BALESS reserves the right not to publish or to delete a review that does not comply with the applicable laws and regulations or with the conditions of this article, and to contact the Client directly regarding the review left.
When publishing a review on the Site, the Client undertakes to comply with the following rules:
- The review must relate directly to the service reviewed.
- The review must not redirect to another website or mobile application and must not contain any contact details.
- The review must not be false, imprecise, unintelligible or misleading.
- The review must not infringe the legal and regulatory provisions in force and, in particular, must not contain any content that in any way infringes the rights of third parties.
- The review must not contain any defamatory, aggressive, insulting, degrading, humiliating or pornographic content, content inciting hatred or violence and, generally, any content likely to undermine public order and morality.
Reviews are kept for as long as the service reviewed is offered for booking on the Site. The Client who wrote a review may request its deletion at any time. The Client may amend their review at any time, even after its publication. BALESS grants the Professional a right of reply.
The Client retains full and complete ownership of the content they create and publish on the Site. By publishing their review on the Site, the Client grants BALESS, on a non-exclusive basis, the right to display and reproduce that review on the Site for information and promotional purposes, for the entire period of publication of the review, within the limit of the period legally granted to the author of an intellectual work, and worldwide.
The Client must have full capacity to contract with BALESS. A Client who is a natural person must be of legal age and have the legal capacity to subscribe to a service. Where the account is created in the name and on behalf of a legal person, the account is deemed to have been created by a person having the capacity and authority to bind that legal person.
Access to the Appointment Booking and Cashback Services is reserved solely for Clients validly registered on the Site.
The Directory Service is freely accessible to any user, whether or not they hold a user account.
To create a user account, the Client must complete the registration form on the Site. The Client undertakes to provide truthful and complete data, not to infringe the rights of third parties in any way whatsoever, to keep the requested data up to date and to correct spontaneously any errors affecting them.
In particular, it is the Client’s responsibility to provide accurate bank details and to update them when they expire. Failing this, the Client will not be able to book a service and will not be able to receive Cashback either.
It is recalled that any consumer may register on the list of objection to telephone canvassing (Bloctel scheme: bloctel.gouv.fr).
The Client will receive confirmation of the creation of their user account by e-mail.
The login credentials (username and password) are unique, personal and strictly confidential. The Client undertakes to use them personally, not to disclose them to third parties and to notify BALESS without delay of any theft or breach of confidentiality of those credentials as soon as they become aware of it.
The contract is concluded for an indefinite term, until the Client unsubscribes. The Client may unsubscribe at any time by requesting the deletion of their user account, either by following the procedure provided for this purpose in their user account or by a clear and unambiguous statement by post or by e-mail.
In the case of a distance or off-premises contract, the consumer in principle has a period of fourteen (14) calendar days to inform the professional of their intention to withdraw from the contract without having to justify their decision.
In accordance with Article L. 221-28 of the French Consumer Code, the consumer may not, however, exercise their right of withdrawal for contracts for the supply of services fully performed before the end of the withdrawal period and, where the contract places the consumer under an obligation to pay, the performance of which has begun with their prior express consent and their acknowledgement of the loss of their right of withdrawal, once the service has been fully performed by the professional.
BALESS cannot be held liable where the damage results from negligence or fault attributable to the Client, from the unforeseeable and insurmountable act of a third party or in the event of force majeure. Force majeure means any external, unforeseeable and irresistible event within the meaning of Article 1218 of the French Civil Code and as defined by case law.
The Services offered by BALESS are standardised solutions that have not been developed for the needs of a particular user. In any event, BALESS cannot guarantee that the Services are suited to a particular need.
BALESS does not guarantee the relevance, truthfulness or accuracy of the information presented on the Professionals’ profile pages, nor the quality of the services, and is not a party to the service contract concluded between the Client and the Professional.
BALESS acts as a mere technical intermediary within the meaning of Article 6, point 2, of French Law No. 2004-575 of 21 June 2004 on confidence in the digital economy. BALESS may remove any content reported to it as fraudulent or unlawful.
These general terms do not effect any assignment of intellectual property rights to the Client.
All texts, images, logos and graphic interfaces on the Site and in all documentation provided by BALESS, as well as the software component and the structure of the Site’s database, are protected by copyright. These rights are reserved worldwide. Consequently, any person is prohibited from copying, modifying, distributing, transmitting, disseminating, translating, extracting, displaying, reproducing, publishing, assigning, licensing, transferring or otherwise exploiting the aforementioned elements, as all such uses may constitute infringement.
It is prohibited to interfere with the source code of the Site in any manner and for any reason whatsoever, including in order to correct errors or anomalies, without the prior express authorisation of BALESS, which alone is responsible for the corrective and evolutive maintenance of the Site.
The content of the Site’s database is protected by the database producer’s right. In accordance with Article L. 342-1 of the French Intellectual Property Code, BALESS prohibits any person from extracting and reusing the content of this database.
It is prohibited to modify or attempt to circumvent any technical protection measure applied to the Site.
Anyone who fails to respect these intellectual property rights is liable to prosecution.
In connection with these terms, BALESS, as data controller, collects and processes personal data. BALESS undertakes to comply with the regulations in force on personal data protection and in particular Regulation (EU) No 2016/679 on the protection of natural persons with regard to the processing of personal data and French Law No. 78-17 of 6 January 1978 on information technology, data files and civil liberties, as currently in force.
BALESS’s full personal data protection policy is accessible on the Site.
These CGS may be amended unilaterally by BALESS at any time. Any amendment will be notified. The content and the date of entry into force of the new version of the CGS will be indicated to users, who will have the option of deleting their user account before the new version of the CGS enters into force. Use of the Services after the entry into force of the new version of the CGS will require its acceptance or, failing that, the deletion of the client account.
These CGS cancel and replace all other CGS previously accepted by the user concerning the same subject matter.
The Client expressly accepts the conclusion of contracts by electronic means. The Parties recognise that an electronic signature has the same value as a handwritten signature.
The fact that one of the Parties does not invoke a default or breach by the other Party of any of its contractual or legal obligations shall not be interpreted as a waiver of the right to invoke that default or breach.
For any complaint, the Client may contact BALESS by post, by e-mail or via the form available on the Site. If BALESS does not respond within 5 working days, the complaint is deemed rejected.
BALESS does not intervene in any way in the settlement of disputes arising between Clients and Professionals.
In accordance with Articles L. 612-1 et seq. of the French Consumer Code, the consumer, subject to Article L. 612-2, has the right to submit a request for amicable resolution by way of mediation, within one (1) year from their written complaint to the professional.
BALESS has designated the Centre de la médiation de la consommation des conciliateurs de justice (CM2C) as its consumer mediation body, which may be contacted:
- By post: CM2C, 49 rue de Ponthieu, 75008 Paris.
- By e-mail:cm2c@cm2c.net.
- Using the online form accessible on the websitewww.cm2c.net.
The consumer may choose to use the European Commission’s online dispute resolution (ODR) platform, accessible via the following link: ec.europa.eu/consumers/odr.
Where the Client is a professional, all disputes relating to the formation or performance of a contract governed by these CGS fall within the exclusive jurisdiction of the Tribunal de commerce d’Evry (Commercial Court of Evry), France, notwithstanding multiple defendants, third-party proceedings, claims under a guarantee or summary proceedings.
These general terms and any contract governed by them are subject to French law, without prejudice to the application of the mandatory provisions of the law of the country in which the consumer has their habitual residence.
